Product Images and Descriptions
Every reasonable effort is made to present products accurately. However, colours and details may appear differently depending on your screen, device settings, lighting conditions and the materials used in printing or production.
Because artwork and fine art prints are visual products, slight variations in colour, tone, texture, dimensions, borders or presentation may occur. These natural variations are not necessarily considered defects.
Product photographs, mock-ups and framed-room images may be used for presentation purposes. Unless expressly stated in the product description, frames, mats, props and display accessories are not included.
Orders
By placing an order, you confirm that:
-
The information you provide is complete and accurate.
-
You are authorized to use the selected payment method.
-
You have reviewed the product description, price and applicable policies.
-
You are legally capable of entering into a binding agreement.
Submitting an order does not guarantee acceptance. An order is accepted once payment has been authorized and Leanne Bishop Art has confirmed that the product or service is available.
Leanne Bishop Art may refuse or cancel an order because of:
-
Product unavailability
-
Incorrect pricing or product information
-
Payment-processing problems
-
Suspected fraud or unauthorized activity
-
Shipping restrictions
-
An inability to complete the order as requested
-
A customer’s failure to pay an applicable U.S. import-duty invoice
-
Another reasonable business or legal concern
If an order is cancelled by Leanne Bishop Art after payment has been received, the amount paid for the cancelled product or service will be refunded, except where an amount is properly non-refundable under a commission agreement or another disclosed policy.
Pricing and Currency
Unless otherwise stated, prices displayed on the Website are in Canadian dollars.
Applicable sales taxes, shipping charges, import duties and other fees may be added to the order where required. Prices may be changed at any time before an order is accepted.
If a pricing or description error is discovered after an order is placed, Leanne Bishop Art will contact you. You may be offered the opportunity to proceed at the corrected price or cancel the affected order for a refund.
Payments
Payments are processed through the payment options made available on the Website, which may include credit card, debit card, PayPal or another third-party payment provider.
Payment methods are subject to authorization and validation by the payment provider. Leanne Bishop Art is not responsible for delays or non-delivery caused by a declined, reversed or unauthorized payment.
You agree to pay all charges associated with your order, including applicable taxes, shipping costs and separately disclosed import duties.
U.S. Import Duties and Tariffs
Physical products shipped from Canada to the United States may be subject to U.S. import duties, tariffs, taxes and processing fees.
For applicable orders shipped through Canada Post, U.S. duties must be calculated and prepaid through Zonos before the shipment can be accepted. These charges are not included in the product price or regular shipping charge displayed at checkout.
After placing an order, U.S. customers may receive a separate invoice for the applicable import duty. The order will not enter production or be shipped until this invoice has been paid.
The amount is determined using factors that may include the product’s declared value, country of origin and customs classification. At the time these Terms were last updated, certain fine art prints were being assessed a U.S. duty equal to 50% of their declared value. Applicable rates and customs requirements may change without notice.
Leanne Bishop Art does not establish or retain government-imposed duties. Amounts collected for this purpose are used to cover charges remitted through Zonos or another customs-payment provider.
Carrier-specific, brokerage or customs-processing fees may not be included in the Zonos calculation and may be assessed separately.
Additional information is available in the Shipping, Returns & Refunds Policy on the Website.
Commissions and Personalized Artwork
Commissioned and personalized artwork may be governed by a separate written agreement addressing matters such as:
-
Scope and composition
-
Reference photographs
-
Pricing and taxes
-
Deposits and payment schedules
-
Revisions
-
Completion estimates
-
Shipping
-
Cancellation
-
Copyright and permitted use
If a separate commission agreement conflicts with these Terms, the commission agreement will govern the commissioned work to the extent of that conflict.
Deposits for commissioned artwork may be non-refundable as specified in the applicable agreement.
When supplying photographs or other reference materials, you confirm that you own them or have permission from the copyright holder and any identifiable individuals to provide and use them for the commissioned artwork. You agree not to submit material that infringes another person’s copyright, privacy, publicity or other rights.
Shipping, Returns and Refunds
Physical-product processing, shipping, delivery, damage claims, returns, cancellations and refunds are governed by the Shipping, Returns & Refunds Policy available on the Website. That policy forms part of these Terms.
Digital products, accessed course materials, commissioned artwork and personalized products may be non-returnable or non-refundable, subject to applicable law and any specific terms disclosed at the time of purchase.
Nothing in these Terms limits any mandatory consumer rights that cannot lawfully be excluded.
Digital Products and Downloads
Digital products may include templates, e-books, printable references, worksheets, guides and downloadable educational materials.
Unless the product listing expressly provides otherwise, purchasing a digital product grants you a limited, personal, non-exclusive, non-transferable licence to download and use it for its intended purpose.
Where a template is specifically marketed for use in your own art business, you may customize and use that template to create finished materials for your own business. You may not resell, distribute, sublicense, share or make the original or editable template available to another person.
You may not:
-
Resell or redistribute digital files
-
Share purchased files publicly or privately
-
Upload files to file-sharing platforms
-
Reproduce resources for students, clients, groups or organizations without written permission
-
Claim the content or design as your own original work
-
Remove copyright notices or branding
-
Use the content to create competing templates, courses, guides or products
-
Use the content to train artificial-intelligence systems or datasets
Because digital products are available for immediate access, sales may be final once a file has been downloaded, accessed or delivered, except where a refund is required by law or the file is materially defective.
Online Courses and Educational Content
Purchasing an online course grants you a limited, personal, non-exclusive and non-transferable right to access the course for the access period described at the time of purchase.
Course access and purchased accounts may not be shared. Course videos, narration, demonstrations, worksheets, reference images, written instructions and supporting resources may not be copied, recorded, reproduced, republished, sold, distributed or used to teach others without prior written permission.
You may download and print designated worksheets and supporting resources for your own personal learning where that option is provided.
Educational content reflects Leanne Bishop’s artistic methods, experience and opinions. Individual results will vary according to factors such as experience, practice, materials and effort. No particular artistic, professional, financial or business result is guaranteed.
Accounts and Account Security
Some services may require an account. You are responsible for:
-
Providing accurate account information
-
Keeping login credentials confidential
-
Preventing unauthorized access to your account
-
Notifying Leanne Bishop Art if you suspect unauthorized use
You may not sell, transfer, share or allow another person to use your account.
Leanne Bishop Art may suspend or terminate account access when there is evidence of unauthorized sharing, misuse, payment reversal, copyright infringement or another violation of these Terms.
Intellectual Property
All artwork, photographs, videos, course materials, written content, graphics, logos, branding, templates, downloads and other original content displayed or provided through the Website are owned by or licensed to Leanne Bishop Art and are protected by copyright, trademark and other applicable laws.
The purchase of an original artwork, commissioned artwork or fine art print transfers ownership of that physical item only. It does not transfer copyright, reproduction rights, licensing rights or commercial-use rights.
Unless Leanne Bishop Art provides prior written permission, artwork and Website content may not be:
-
Copied or reproduced
-
Used on merchandise or commercial products
-
Used in advertising, branding or promotional materials
-
Modified or used to create derivative products
-
Minted or sold as a non-fungible token or other blockchain-based asset
-
Scraped, collected or used to develop or train an artificial-intelligence model, dataset or image-generation system
-
Licensed, distributed or sold in any form
Customers may display purchased physical artwork for personal use and may share personal photographs of it on social media, provided the artwork is not reproduced or used commercially and Leanne Bishop Art is credited where reasonably possible.
The names “Leanne Bishop Art” and “Leanne Bishop Art Academy,” associated logos, monograms and brand elements may not be used without prior written permission.

Limitation of Liability
To the fullest extent permitted by applicable law, Leanne Bishop Art will not be liable for indirect, incidental, special or consequential loss arising from use of the Website, products, services or third-party platforms.
Where liability cannot lawfully be excluded, the total liability of Leanne Bishop Art relating to a particular product or service will be limited to the amount you paid for that product or service, except where a greater remedy is required by applicable law.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability arising from fraud, intentional misconduct or another matter that cannot legally be limited.

Breach these Terms

Infringe intellectual-property rights

Share restricted content or account credentials

Governing Law and Dispute Resolution
These Terms are governed by the laws of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law principles.
If you have a concern or dispute, please contact info@leannebishopart.com so that both parties can first attempt to resolve it informally and in good faith.
If a dispute cannot be resolved informally, it may be brought before a court of competent jurisdiction in British Columbia, subject to any mandatory consumer rights or jurisdictional protections that apply where you live.
Consumers residing outside Canada retain any mandatory protections provided by the laws of their jurisdiction that cannot legally be waived.
Changes to These Terms
Leanne Bishop Art may update these Terms periodically to reflect changes to products, services, business practices or legal requirements.
The updated Terms will be posted on the Website with a revised “Last updated” date. Material changes will apply prospectively unless otherwise required by law.
Your continued use of the Website after updated Terms take effect constitutes acceptance of the revised Terms. Changes will not retroactively alter the material terms of an order that has already been accepted unless required by law or agreed to by both parties.
Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.
No Waiver
A failure by Leanne Bishop Art to enforce a provision of these Terms does not waive the right to enforce that provision or another provision later.
Entire Agreement
These Terms, together with the Privacy Policy, Shipping, Returns & Refunds Policy, applicable product descriptions and any separate commission agreement, form the agreement between you and Leanne Bishop Art concerning your use of the Website and purchases made through it.
If a separate written agreement applies to a specific product or service, that agreement will govern to the extent of any direct conflict.
